Terms and Conditions 

By submitting this application, you agree to the terms and conditions outlined herein. If the application is accepted, we will send a confirmation of your acceptance to the program, along with an invoice detailing the payments due. By making the first payment on that invoice you agree to pay all tuition, accommodation, and associated fees incurred by the student as they become due in accordance with these Terms and Conditions. Wherever these Terms and Conditions have been translated, the English version of the Terms and Conditions supersedes the translated version in the event of ambiguity.

Acceptance Requirements
English language requirements

Students are required to have a certain level of English for admission to ECH Academy. Recommended minimum B1.

Contact your local ECH office to learn about the specific English level requirements for each program.

No additional refunds will be granted for students deciding to leave the school due to a decision from ECH Academy to move the student to another course.

Academic requirements

If students do not meet the academic criteria of their original chosen program, they will not be allowed to proceed but will be offered an alternative course or invited to withdraw without a refund.

Special educational needs ECH Academy requests that any applicant’s known special educational needs are communicated during the application process in order for ECH Academy to determine whether the school can accommodate such needs.

Health requirements

Students are accepted on the basis that their mental and physical health allows them to participate in full time studies abroad. Parents or guardians are required to inform the school of any medical condition that may affect the student’s performance, behaviour or safety in the school before applying for admission. Any form of medical condition including any type of mental health condition affecting the student together with information about any medication or regime required by the student must be made known in English to the school or local ECH office who will share this information, as appropriate, with the host family or residential advisors and school officials. To be eligible to participate in the program, the student must have a Health Certificate completed by a doctor, including certificates of immunization, which must be signed by their parents or guardians. ECH Academy reserves the right to withdraw students without any refund with pre-existing medical conditions and/or special medication needs that were not mentioned in the Health Certificate/ Medical Declaration prior to their arrival.

Issuance of visas

Special conditions apply for students requiring visas to study at any of ECH Academy’s campuses.

− Italy: ECH Academy will only issue visa application documents once a student has paid at least 1 term of tuition and accommodation fees of the academic year, signed the Parental Consent form and signed the Code of Conduct.

− Malta: ECH Academy will only issue visa application documents once a student has made a full payment for the academic year, signed the Parental Consent form and signed the Code of Conduct.

At school
Arrival to school

Students are required to arrive to school at the beginning of each term during the days communicated by the school. Students arriving late will be marked as absent affecting their grades and potentially also their visa. No refunds will be granted for time missed due to late arrival.

Airport transfers

ECH Academy offers airport transfers for all new students on arrival day (see the price list). As per safeguarding measure, all new students traveling alone are required by ECH Academy to use this transfer option. Please contact your local ECH office or representative for details

Accommodation rules

ECH Academy’s aim is to always provide the accommodation requested, the school is however not bound to provide a specific type of accommodation and will, if necessary, provide an alternative arrangement withing the range of accommodations offered. A student who wishes to terminate a current residence stay will have to give one term notice. ECH Academy will retain all costs paid for the residence space for the notice term. Any change in accommodation arrangements during the school year are subject to prior written approval by the Head of School of the respective campus. Accommodation is included during the spring or winter holiday period. Contact your local ECH office or representative for details. Summer accommodation is not available unless enrolled in a summer course.

− Torbay: Residence accommodation is mandatory for students under the age of 16.

Meals

Breakfast, lunch and dinner during the week as well as brunch or breakfast and dinner during the weekends are included depending on your purchased course. Please visit Plans &Pricings to see what is included in our package.

Holidays

No holidays will be authorized outside of the school calendar holiday dates and students not in school will be marked as absent affecting their grades and potentially also their visa. Students that are absent during the course will not be granted a refund. Periods of absence may not be made up with free extension of the courses. Should a student choose to return to their home country or take a holiday during the course, accommodation and meals will not be refunded. ECH Academy is following the calendar in the country of study. No classes will take place on national public holidays.

Travel insurance

ECH Academy has negotiated and entered into a tailor-made insurance group policy with the insurance provider CM Insurance SRL., under which ECH International Academy is the policyholder. Nevertheless, all students attempting a course at ECH Academy has to prove that they have purchased a travel insurance prior to the arrival to the campus. Students are covered by this insurance from the time they depart for school until their return home. Students are not covered if and when they return to their home country during the course of the program. Non-Italian and Non-Maltese residents are required to provide evidence of personal insurance by sending a copy of the insurance coverage to the admissions office at admin@echacademy.com.The complete general conditions are available on https://agenzie.axa.it/. ECH Academy requires a policy covering the equivalent of GBP 100,000/ USD 170,000 third party liability insurance.

Personal property

The CM Insurance policy does not include coverage for personal property. No responsibility can be accepted by ECH Academy for any loss or damage, which may occur while the student is living with a host family or in dorm/residence.

 

Breakages, loss or damages

Students are responsible for any damage caused by them to school property and household property of their host family.

 

School organizational policies

Each ECH Academy campus has several individual school policies such as Health and Safety, Code of Conduct, Sanctions, Complaints and Exclusion. These are made known to students on arrival and are available on request from each campus.

 

Academic criteria for examination entry

ECH Academy reserves the right to not enter students who do not perform satisfactorily in their course work. The criteria for entering into external examination will be based on formal assessments that takes place at least once a month. The assessment will take into account:

− Course work

− Internal examination results

− Attendance

− Effort in class and homework

− Public examination potential

Entering external examination is subject to additional fees.

 

Medical treatments at school

ECH Academy is authorized to take any action deemed necessary for students’ safety and wellbeing, including notifying parents/ guardians and/or securing medical treatment (at the parent/guardian’s expense). ECH Academy retains the right, in its sole discretion, to contact the student’s parents/guardians with regard to health issues or any matter whatsoever that relates to the student. These rights transcend any and all privacy regulations that may apply. If, in the opinion of a properly licensed and practicing physician, a student needs medical or surgical services which require parents’ pre-authorization or consent, parent hereby authorizes, appoints, and empowers ECH Academy to furnish such consent on parent’s behalf. Parent confirms that it is parent’s desire that student be furnished with such medical or surgical services as soon as reasonably possible after the need arises. Parent hereby releases and holds the school harmless from any liability, which might arise from the giving of such consent. The school is hereby authorized to supply minor medical care or emergency support as determined to be appropriate by the school staff. The parent also authorizes the school’s pathway managers and counsellors to meet and counsel with student regarding emotional, social, or family circumstances. You hereby release and hold the school harmless from any liability, which might arise from the provision of such medical care or counselling services.

Finance

Methods of payment & deadlines

The application cost and the program cost can be paid through ECH Academy’s website in Plans & Pricing, with bank transfers or Debit/Credit card transaction (contact your local office for instructions). Please note that all transfers must reference the full name of the student, school and booking reference number to ensure quick and proper credit to their account. The sender of funds should pay the bank charges and commissions for both the sending and receiving banks or they will be applied to the student’s account. ECH Academy accepts Cash payments in case of an emergency only. To secure a place in ECH Academy programs, payment of a school specific first instalment is payable immediately upon admission. Cancellations communicated after payment of the first instalment are subject to cancellation fee as outlined in this document. Please contact admin office for more details regarding instalment payments.

 

Each student will receive an individual payment schedule in conjunction with their initial invoice depending on the time of enrolment. Final balances have to be settled no later than 60 days prior to course start.

 

If any costs become overdue, ECH Academy reserves the right to suspend or cancel enrolment. ECH Academy reserves the right to send home students arriving to school with outstanding financial obligations towards ECH Academy at the parent’s/guardian’s expense. In every case, ECH Academy will charge a late payment fee if all costs are not paid by the time a student arrives to school.

 

Summer preparation courses

Students enrolling in a summer language preparation course are required to pay at least one term of their subsequent course (tuition and accommodation fee) prior to arriving to campus.

 

Continuing students

To secure a place for the following school year, continuing students - including students enrolled in the English language preparation course - must pay one term’s program cost (course & accommodation cost) as per invoices sent out during February of each calendar year. The total balance is due 60 days before start of the school year. Payment for a subsequent course also implies agreement with any updated Terms and Conditions that are available on ECH Academy’s website.

 

Tuition and costs

ECH Academy reserves the right to adjust the program content, program costs and other costs due to international currency fluctuations, increase in transportation costs or any other factors beyond its control (including but not limited to force majeure events). Costs are subject to change during the period of enrolment. Costs published in this catalogue are valid for the academic year 2022/2023 only commencing from October 2022. All costs are reviewed in August each year. Notice of changes will be given in advance.

Terminations

Cancellations, withdrawals, and refund policy

All cancellations and terminations must be made in writing to your nearest ECH office or local ECH representative. For any refund claims, ECH Academy will consider the date of the written notice of cancellation/termination. In all cases, the application/enrolment cost is non-refundable. For a refund of the course, the applicant must give at least 60 days’ notice prior to the start of their course.

You understand that the overhead expenses of ECH Academy do not diminish with the departure of some students during the course of the school year and it is impossible to calculate the specific losses that may occur due to a cancellation or withdrawal. Therefore, once you have paid the first instalment to confirm your place at one of ECH Academy’s campuses you become liable for the tuition and fees as liquidated damages (and not a penalty) even if the student is withdrawn, absent, or is involuntarily separated from ECH Academy.

Refunds will be available only as outlined in this Agreement.

 

Cancellation prior to start of school

Students cancelling 60 days or more before the start of the program or continuing school year will be charged a cancellation cost equivalent to 7% of the course and accommodation cost (three terms). The student will receive a full refund of any additional payments except for the non-refundable application/enrolment cost. Students cancelling less than 60 days before the start of the program or continuing school year but before arriving at the school will be charged a cancellation cost equivalent to 20% of the course and accommodation cost (three terms). The student will receive a full refund of any additional payments except for the non-refundable costs mentioned above.

 

Withdrawals after arrival at the school

If a student provides ECH Academy written notice at least four weeks before the end of the first term, ECH Academy will refund the tuition and accommodation fee paid for the third term. No other refunds are available for withdrawing students. Please note that although students may leave the school after their examinations, no costs will be reduced or refunded.

 

Expulsion

Students are admitted on condition of these terms and conditions and any other relevant school policies and rules communicated by ECH Academy. ECH Academy reserves the right to expel any student who breaches school rules, who the school administration considers detrimental to the school community, or for failure to meet financial obligations towards ECH Academy. There will be no refund in the event of expulsion. Furthermore, the student’s visa and Erika insurance coverage (if applicable) may be affected.

Terminations

Publicity

ECH Academy and the ECH Group have the right to photograph, video and quote students in the course of their program. The term “ ECH Group” means ECH Academy, other companies within the group to which ECH Academy belongs from time to time, its ultimate beneficial owner(s) and any and all companies directly or indirectly, wholly or partly owned or controlled by such ultimate beneficial owner(s) and/or directly or indirectly associated or affiliated with ECH Academy as well as any foundation, or other charitable organization related to, or created by, or receiving management services from any such company. You, and your parent/legal guardian (if applicable) consent to the ECH Group’s use of their likeness in advertising, promotional, marketing and preparatory materials, including, but not limited to, printed material, video, film and internet uses. All such material shall become the property of the ECH Group. Students and their parents or guardians agree that a student’s first name and last initial, photographs or achievement details may be used for promotional purposes without further written consent or compensation.

Liability for the student

Any liability for the student shall also infer liability on the parents or guardians of the students, and such liability is joint and several. The parent/guardian of the student hereby agree and accept such joint and several liability on behalf of the student.

 

Liability

ECH Academy will not be liable in any way to the student in the event of any service contracted to be supplied by ECH Academy becoming impossible to supply, in part or in full, by reason of any cause outside the reasonable control of ECH Academy (including but not limited to force majeure events). ECH Academy will not be liable for loss, damage, or injury to persons or property howsoever caused, except where the liability is expressly imposed beyond exclusion by statute. The student and their parents or guardian hereby agree to release and indemnify and hold harmless ECH Academy and its affiliates, which shall include related entities, officers, directors, shareholders, agents and/or employees of any ECH entity or others to the extent acting or purporting on aforementioned persons’/entities’ behalf (all of said persons/entities hereinafter being referred to as “Released Parties”), and agree not to sue the Released Parties for any claims that student, parents or guardian may have arising from, or in connection with, any personal injury, bodily injury, mental anguish, emotional distress, physical, property, or other damage they may suffer from any cause whatever related in any way to student’s participation in any program or event related to the ECH Academy program, including negligence other than from intentional or reckless acts by such parties. The student and their parents or guardian hereby further agree to release, indemnify and hold harmless the Released Parties from any and all acts of God, war (whether declared or undeclared), terrorist activities, incidents of politically motivated violence, illness or quarantine, strikes or government restrictions or the acts or omissions of any other persons over which the Released Parties have no control, including without limitation, airlines, railways, bus companies, taxis, friends, and other students.

 

Accreditation

ECH Academy in the Italy and Malta are TEFL Accredited facilities, offering the TEFL accredited certificates. IELTS and TOEIC accreditation is provided by Wall Street English, Viale Vincenzo Randi, 39/41 - 48121 Ravenna (RA). All ECH Academy programs are organized by ECH Academy, Viale Luigi Cadorna 14 - 48015 Milano Marittima (RA). Please return a signed copy of this Application to your local ECH office. You will find the address on www.echacademy.com. These Terms and Conditions apply to all admissions made for courses commencing in 2020. The Terms and Conditions shall be governed by and constituted in accordance with the laws of Italy and Malta. Any dispute arising out of or in connection with these Terms and Conditions or the program shall be settled by ordinary courts of Italy and Malta.

 

Changes in the terms and conditions

ECH Academy reserves the right to make any addition, amendment or alteration to these Terms and Conditions in furtherance of our commitment to continuous improvement.

 

By signing, we acknowledge that we have read, understood and accepted all of the provisions provided in the Terms and Conditions, including the Code of Conduct for the school.

Privacy Policy

Our commitment to protecting your privacy

ECH Academy is committed to protecting the privacy of its current and future customers. ECH's privacy policy, applies to all Personal Data (as defined below) processed by us, including Personal Data collected or submitted through our websites, our mobile applications, our official social media pages or through other online and offline channels as described below in more detail.

 

If you cannot, or do not wish, to provide us with the personal information reasonably requested by us, we may not be able to provide you with the information, products or services you have requested.

 

The ECH company that processes your Personal Data as described in this Privacy Policy can be identified here based on which ECH products interest you or have used. This company is responsible for ensuring that your Personal Data is processed in accordance with applicable privacy and data protection regulations.

 

Personal data

"Personal Data" is information or parts of information that could allow your identification, such as:

• Name and contact details (e.g. postal address, email address, telephone number) • Account information (e.g. username, profile picture, or social media account ID

• Country of residence

• Date of birth

• Technical information, e.g. username, IP address, browser and device data, information collected through cookies, pixel tags and other technologies, server log file data, app usage data, and location data

• Preferences (e.g. shopping habits, preferred training courses)

• Name and address of the school or company

• Credit and debit card number

• Clinical situation (e.g. allergies or diseases)

 

How do we collect Personal Data?

We collect Personal Data in various ways:

• Directly from you: We obtain information directly from you when you provide it explicitly yourself or when your actions allow us to collect it. For example:

- Offline: We collect your Personal Data offline, for example when you contact customer service, sign up for a program or book a service or provide us with information by writing to us;  

-Online: We collect your Personal Data through ECH channels, such as when you sign up for a newsletter or request a catalog, or when you use a product or service. We also collect Personal Data:

  • Through cookies. Cookies allow a web server to transfer data to a computer or device for storage and other purposes. If you do not want information to be collected through the use of cookies, most browsers provide a simple procedure that allows you not to authorize their use. For detailed information about the cookies we use and the purposes for which we use them, see our cookie policy.

  • Through your use of a mobile application. When you download and use one of our mobile applications, and to the extent permitted by your privacy settings related to the application itself, we track and collect usage data for that application, such as the date and time you accessed our servers and what information and files were downloaded based on your device number.

  • Through your device. If you have enabled the relevant feature on your device, we detect its physical location to provide you with services and content tailored to your location. You can learn more about this type of service in the section "How do we use Personal Data?"

From our affiliates, partners, service providers or claims managers. We may receive Personal Data from other parties in connection with your course/program, including:

  • Our affiliates, such as the local ECH company that promotes the sale of our services, manages customer service in your country of residence and provides us with the Personal Data necessary to reach an agreement relating to your request, or the school in your destination country that provides some of the services you have requested, or the main company that is based in Italy and is responsible for the performance of your contract for any ECH offer.

  • Business partners, such as local sales agents who promote sales of our services in your country of residence.

  • Claims managers who receive information regarding your claims related to your insurance coverage.

From other sources. We may receive your Personal Data from other sources, such as: public databases; business partners such as marketing agencies or providers of software and services for the automation of digital marketing and analytics; social media platforms that include, among others, Facebook, Instagram, Snapchat, Musically, LinkedIn, Twitter, YouTube and messaging services such as WhatsApp or Facebook Messenger; people with whom you are friends or otherwise connected on social media platforms, and other third parties. For example, if you decide to link your social media account to your ECH Products account, the Personal Data you have saved in your profile, such as email address, phone number, postal address, date of birth, name and username, will be shared with us. In addition, we use cookies to track members of social networks as described in more detail in our cookie policy.

If you visit our sites. We may also collect information related to your use of our services through your browser to track activity on our sites; for example, we may obtain your MAC address, computer type (Windows or Macintosh), screen resolution, operating system name and version, device manufacturer and model, language, browser type and version, service provider, and the name and version of the ECH Product you are using. In addition, an IP Address is automatically identified and recorded in our server log files each time you visit ECH Products, along with the time of your visit and the pages that were visited. This data is stored and used together with other Personal Data that you have submitted only if you have given your consent. ​How do we use Personal Data?

Your Personal Data will be processed by ECH to complete your booking, to provide you with the products and services you have requested (including travel insurance coverage), for customer support, for administrative services or for other purposes necessary for the performance of your contract with us or as detailed in this policy.

• We may also use Personal Data:

  • For statistical purposes, to calculate usage levels, to help diagnose server problems related to ECH Products, and to ensure that ECH products function properly.

  • To enable you to contact and be contacted by other users through ECH Products, in the manner provided by the product used.

  • To allow you to participate in forums, chats, profile pages and blogs and use other services that allow you to publish information and materials.

  • If you have given your consent:

- To analyze and improve our offerings by identifying usage habits, determining the effectiveness of our promotional campaigns, and customizing the experience and content of ECH Products based on your previous interactions with ECH Products. For example, depending on the ECH Products you have searched for on our site or in previous browsing, the offer you are presented with on ECH Products may be limited to a certain language, a specific course length or a certain budget.

- To provide you with services and content tailored to your location through the use of your device's physical location. For example, if your device indicates that you are browsing from your country of residence, you will be redirected to the local ECH site located in your language, or you may be suggested the ECH office closest to your location to get appointments or information.

- To advertise our products and services, including special promotions based on your interests, for example through (i) management software for managing email marketing campaigns such as Salesforce Marketing Cloud, which allows you to manage mailing lists and to schedule and customize email messages based on what recipients read, click or forward - all e-mail communications of this type will include a clear and obvious link to be able to unsubscribe; (ii) automated contact methods such as sms, social networks; (iii) instant messaging apps; (iv) push and traditional notifications such as telephone calls with an operator (so-called telemarketing); and (v) traditional mail.

- For the transmission and communication to third-party companies (including Accueil S.r.l., Wekiwi S.r.l. for sending information and commercial communications, including promotional communications (including the newsletter), advertising material and / or offers of goods and services also through direct marketing activities including telemarketing.

How do we share Personal Data?

We share your Personal Data with our affiliates, partners and service providers both inside and outside the EEA and Switzerland:

  • Our affiliates may be, for example, a local ECH company that promotes sales of our services and manages customer service in your country of residence, or the school in your destination country that provides some of the services you have requested, or one of the leading companies that offers another of the ECH programs.

  • Partners may be, for example, local sales agents who promote sales of our services in your country of residence, transportation and accommodation providers in your destination country, our course leaders, business leaders or other consultants for the management of any of our programs, or an insurance agency that prepares travel insurance for you.

  • Service providers, such as IT system providers, which make it possible, for example, to manage customer relations or payments, to organise lectures or to store academic achievements; or providers of software and services for the analysis and automation of digital marketing.

 

We have put in place appropriate safeguards for the transfer of your Personal Data outside the EEA and Switzerland. We also share Personal Data to the extent we deem it necessary: (a) under applicable laws; (b) to comply with legal obligations; (c) to respond to requests from public and governmental authorities outside your country of residence; (d) to enforce our terms and conditions or a contract; (e) to protect our operations or those of our affiliates; (f) to protect our rights, privacy, security or property, and/or those of our affiliates, customers or others; and (g) to enable us to pursue available solutions or limit the damages we may sustain.

On what do we base our right to collect and use Personal Data?

Our right to collect and use your Personal Data is based on the need to obtain such information in order to be able to provide you with the services or products you have requested, or on the presence of a legitimate interest for us (i.e. the service provider) to use your Personal Data, for example for advertising products or services similar to those you have already purchased from the same legal entity.

 

When we use Sensitive Personal Data, we do so with your explicit consent. Sensitive data can be, for example, information about health, ethnicity or religious beliefs. You can get more information about this in the "Sensitive data" section.

 

When we use your Personal Data to send you offers beyond what is considered within our legitimate interest, such as advertising products and services provided by an ECH affiliate including through direct marketing activities including telemarketing and we transmit your Personal Data to third parties, we do so with your specific consent.

Safety

We use appropriate organizational, technical and administrative measures to keep the Personal Data under our control accurate and up to date and to protect it from unauthorized or unlawful processing and its accidental loss, destruction or damage

Unsubscribe

If at any time you wish to stop receiving marketing communications from us, you can use the unsubscribe functionality contained in the commercial message you receive or notify us of your intention using the contact information listed in the "Contact Us" section. In your request, please indicate that you wish to stop receiving marketing communications from us.

 

Changes may not take effect immediately. We will attempt to comply with your requests as soon as reasonably practicable.

Third Party Sites

This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of third parties, including those that operate sites that can be accessed from a link contained in an ECH Product. The inclusion of a link in an ECH Product does not imply endorsement of the linked site by us or our affiliates.

 

In addition, we may provide access to third-party features that allow you to share your interactions with ECH Products on your social media accounts, such as Facebook and LinkedIn. Any information you provide through the use of this feature is governed by the appropriate privacy policy of the third party, and not by this Privacy Policy. We have no control over, and are not responsible for, the use of the information provided through the use of this feature by third parties.

How long do we keep personal data?

We retain your Personal Data only for as long as necessary for the purposes for which it was collected or in compliance with the time limits stipulated by law and market practice; exceptions are cases where it is necessary to keep Personal Data longer in compliance with legal obligations or to establish, exercise or defend a right by judicial means, and cases in which a specific period of time has been communicated.

 

We will retain limited parts of your Personal Data as necessary for marketing purposes until you withdraw your consent; in any case they will not be kept for more than 24 months from the conclusion of the last service you used or from the last delivery of a product.

If you are under 16 years old

If you are under the age of 16 you should review this document together with a parent or guardian to make sure you understand both. It is not our responsibility to check your age, but sometimes we carry out checks. If we discover that you are under the age of 16 and that we have collected information about you without the consent of a parent or guardian, we will delete the information as soon as possible and you will not be able to use ECH Products.

Sensitive Data

We generally do not collect any Sensitive Data. Sensitive Personal Data is data relating to ethnic or racial origin, political opinions, religious or philosophical beliefs, clinical situation or health conditions, criminal record or trade union membership. In certain situations, however, this may be necessary (for example to provide you with services and products that you have requested and in relation to your insurance). It will be our responsibility to ensure that we have your explicit consent for the processing of this type of information, which we will manage safely.

Updates to this Privacy Policy

Our Privacy Policy may change from time to time. We will not drastically reduce your rights described in this Privacy Policy without informing you. We will post any changes to this Privacy Policy on this page and, prior to implementing such changes, we will highlight an explicit warning. Where required by law, we will request your consent to any changes.

Your Rights

You have the right to contact us and, at no additional cost, find out what information about you is being used. You have the right to receive your Personal Data in an automatically readable format and you have the right to transfer your personal data to another controller.
